Terms & Conditions
1. Application and interpretation
1.1. These terms and conditions govern your participation in the campaign conducted by the organisation identified on this campaign (the “client”) using this online platform. References to the campaign include the relevant petition, advocacy action, proposed communication, public submission or social-media activity made available by the client.
1.2. The client is the organisation using the platform to conduct the campaign and receive the information collected through it. By selecting “I agree with the Terms and Conditions” and submitting the relevant form, you acknowledge and accept these terms, including the data-handling provisions set out below. Participation is voluntary; if you do not agree, do not submit the form.
2. Client access to information and permitted use
2.1. the organisation identified on this campaign will have access to personal information and participation records collected through this campaign. You authorise the collection, processing and, where enabled, storage of the information you submit for campaign administration, the recording of participation and the preparation and facilitation of the communications or actions you request. This may include sensitive information about political opinions or affiliations that you choose to disclose.
2.2. The client’s access includes access for marketing purposes, supporter communications, campaign follow-up and related engagement activities. the organisation identified on this campaign is responsible for ensuring that any such use, disclosure or communication is permitted by applicable privacy, direct-marketing and communications law, and for obtaining any consent or other permission required for that activity. These terms describe the client’s access and responsibilities; they do not confer unrestricted rights to use sensitive information for unrelated purposes.
2.3. Information must not be sold, disclosed or repurposed merely because it is technically accessible. Any further use must be consistent with the applicable collection purpose, permissions and legal obligations. The privacy, access and complaints provisions at the end of this document form part of these terms.
3. Participation, accuracy and acceptable use
3.1. You must provide information that is accurate to the best of your knowledge, act on your own behalf or with appropriate authority, and be capable of understanding and giving the consents relevant to your participation. You must not impersonate another person, submit another person’s information without authority, or use the service to distribute unlawful threats, harassment, defamatory material or content infringing another person’s rights.
3.2. You remain responsible for reviewing, editing and deciding whether to use any generated content. Automated or AI-assisted drafting may be incomplete, inaccurate or unsuitable for your circumstances and is not legal, electoral or professional advice. The client’s campaign statements and political views are those of the client and are not independently verified merely by appearing on the platform.
4. Communications and third-party recipients
4.1. Unless expressly indicated otherwise, an email or social action prepares material for you to send or share through your chosen provider; generation alone does not establish delivery. The availability of the service does not warrant that a message will be delivered, that a recipient will respond, or that a submission will be accepted or have any particular effect.
4.2. Material sent to representatives, committees, public bodies or other recipients may be retained, forwarded or published in accordance with their procedures and applicable law. Selecting a private or name-withheld submission expresses a request to the recipient and is not an absolute guarantee against disclosure. Review the recipient’s requirements before transmitting material.
5. Intellectual property and user content
5.1. Existing rights in campaign content, branding, software and third-party material remain with their respective owners. You retain your rights in original content supplied by you and grant the limited permissions reasonably necessary to process, display, store where disclosed and facilitate your requested participation. You may retain a copy of your generated communication for your own use, subject to third-party rights.
6. Availability, variation and suspension
6.1. Access may be restricted or suspended where reasonably necessary for maintenance, security, suspected unlawful conduct or a material breach of these terms. Notice will be provided where practicable and appropriate. Material changes to these terms must identify their effective date and be brought to users’ attention where reasonably practicable; they do not retrospectively remove accrued rights or enlarge a previously given consent.
7. Statutory rights, applicable law and severability
7.1. Nothing in these terms excludes, restricts or modifies a consumer guarantee, statutory remedy or liability which cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation. Any limitation is effective only to the extent permitted by law. No indemnity for another party’s own wrongdoing is imposed by these terms.
7.2. Australian law and applicable state or territory law govern the relevant participation. The right to approach a competent court, tribunal or regulator is preserved. If a provision is unenforceable, it is to be read down or severed to the minimum extent necessary without affecting the remaining provisions or mandatory rights.
Privacy, access and complaints — collection and purposes
the organisation identified on this campaign is the client using this campaign platform and has access to the personal information collected through it. The client determines its purposes of use, authorised personnel, communications and lawful disclosure, subject to applicable law and the consent or permissions relevant to that information.
Depending upon the campaign, information may include your name, email address, telephone number, address or postcode, personalisation text, generated communications and a record of participation or support. Political opinions and affiliations disclosed in that information may constitute sensitive information. Information is processed to administer the campaign, record participation where collection is enabled, prepare communications and facilitate the action you request. Optional fields may be left blank; absence of required information may prevent the requested action.
The client has access to collected contact and participation data, including for its marketing, supporter communications and engagement activities. Such access does not dispense with any consent, purpose limitation, identification or opt-out requirement imposed by applicable law. Agreement to these service terms does not, of itself, constitute consent to unrelated direct marketing.
Privacy — recipients, processing and retention
Access may be provided to the client’s authorised personnel and to service providers and administrators to the extent reasonably necessary to operate, support and secure the service. Technical records may include IP addresses, browser details, timestamps, activity events and consent records. Staff authentication tokens and preferences may be retained in browser storage.
Campaign instructions and personalisation text may be processed by configured AI services, including Google Gemini or OpenAI. Do not include unnecessary information about yourself or another person. Email and social providers, elected representatives, committees and other selected recipients handle material you elect to send or share under their own arrangements; their publication, response and retention practices are not controlled by these terms.
Hosting, database and other service providers may process information outside Australia. The applicable providers and destination countries depend on the service configuration; a complete country list has not yet been verified. Current particulars may be requested at the contact below before submission. No provision of these terms waives an applicable cross-border privacy obligation.
Access controls and other reasonable safeguards are used, but absolute security cannot be warranted. Records are not presently subject to a single automatic deletion period. Retention is to be assessed against the collection purpose, legal obligations and any applicable preservation requirements; information no longer required should be securely destroyed or de-identified. Backup copies and information already supplied to recipients may be subject to separate lawful retention arrangements.
Service provider
Civipen is the technology service supplied by Overton Solutions to the client. Overton Solutions is the platform provider, not the organiser of the client’s campaign, and does not determine the client’s political position or marketing strategy. Provision of the technology does not displace any privacy or other statutory obligation that independently applies to either the client or the provider.
Privacy — access, correction, withdrawal and complaints
Requests concerning access, correction, withdrawal of consent, appropriate deletion or a privacy complaint may be directed to info@overton.solutions. Identify the client and campaign concerned and the email address used. Enquiries concerning the client’s records or communications may need to be referred to that client. Reasonable verification of identity may be required before personal information is released or amended; do not send passwords, authenticator codes or identity documents unless an appropriate secure process has been agreed.
Withdrawal of consent operates prospectively and does not reverse a communication already delivered or processing lawfully undertaken. Access, correction and deletion requests are subject to applicable law, including lawful exceptions and retention requirements. For marketing communications, use the sender’s unsubscribe facility or request that further marketing cease; the client remains responsible for compliance with applicable opt-out requirements.
Complaints should receive a prompt acknowledgement, with an intended substantive response within 30 days. If unresolved, a complaint may be made to the Office of the Australian Information Commissioner where it has jurisdiction. Suspected breaches must be assessed and notifications made to affected individuals and regulators where required by the applicable Notifiable Data Breaches regime.
